THERE ARE NO GUARANTEES YOU WILL RECEIVE YOUR WISH IN AN ALLOTTED TIME BUT THERE IS HOPE AND THERE ARE MANY WORKING TOWARDS YOU GETTING YOUR WISH. THE LESS AMOUNT OF MONEY WISHED FOR THE LESS TIME IT GENERALLY TAKES FOR THE WISH TO BE GRANTED. YOUR WISH ITEM IS THEN PAID FOR BY US.

ALL MONEY GIVEN TO THE WISHER GOES TO THE WISHER'S FUND WITH THE EXCEPTION OF THE SMALL PAYMENT PROCESSING CHARGE WHICH IS CURRENTLY UNAVOIDABLE. NO GIFT MONEY GOES TO ADMIN OR SALARIES.

WE FEEL WE CAN DO FAR MORE FOR YOU AS A BUSINESS THAN AS A CHARITY WITH GREATER FLEXIBILITY AND QUICKER GRANTING OF WISHES AND GAINING THE MONEY TO RUN THE COMPANY FROM OUTSIDE SOURCES RATHER THAN THROUGH DONATED MONEY.

(With this in mind, here are the terms of use of Wishes and Angels Ltd website!)

BUSINESS

Hello and welcome to Wishes and Angels. We hope you can take time to read these terms of use so that in the event of you being unsure of anything, you can refer to them. Always best to know these up front rather than after the horse has bolted so to speak!

The official term one would use for our kind of site these days is a non charitable micro-giving philanthropic and social networking site. We are profit making, with a minimum of 90% of that profit going right back into the wishes on the site. As profit rises, so will this percentage and we will notify by way of email at the end of each year what we have given back to the site. We are also currently looking at part of the profit going into a separate foundation.


Wishes and Angels, is a new way, not the only way but certainly a different way of reaching those who may not be eligible for a charity event in their honour or the yearly charity single. It is for those with and without computers, young and old, with or without a home, those under the radar, those who need help, those who just need a little lift to get them going on life's crazy paved path again. Wishes and Angels gives you the advantage of seeing exactly to whom your money is going, what it is going towards and in many cases rewarding pictures of the end result.

Our aim is to bring those who have small and big wishes in life together with those willing and able to grant those wishes. It is an unfortunate fact that we cannot in many societies today live without money. Housing, transport, food, leisure, clothing, heating and even our health require funding. In the current financial climate, people often find themselves unable to adequately finance even the basic necessities in life for themselves and their families. This is where we come in.

We are not a charity. In order to maximise profit so that we can in return give much of that back to the site and have control over how that money is spent and given, we have taken the decision not to go down the charity route. We hope our profits will be well above what is allowed by the charities commission and then be in a position to make sure many more wishes are fully granted through our own funds. We make our money from advertising fees and wish fees and with the exception of monies charged by the banks for a payment, all the money given by the 'Angel' goes to the 'Wisher'.

One of the concerns on such a site is people asking for money in the form of cash and using it in a manner not appropriate to the whole ethos of our site. Therefore, we will in most cases, when your target has been reached, pay directly for your service or item and have the item sent to you where appropriate. Please bear in mind your postage fee when asking for money. There may be some situations where receiving cash funds is the only way around a situation and in all of those situations we will undertake appropriate verification checks by way of letters from and phone calls to the appropriate professionals and/or service providers.

NOW THE SLIGHTLY MORE TEDIOUS BUT NONETHELESS IMPORTANT STUFF.

AGE LIMITATION

We have no doubt that many youngsters out there could make sensible and mature use of the service, however, we feel that we have to put an age limit on wishing to help protect any young people against the increasingly clever methods used by unscrupulous people in trying to construct inappropriate relationships with the child. Our age limit without a letter is therefore 18 (18 is the age of legal responsibility in many countries including USA) years old. If a younger person wishes to take part in the wish process then a letter from the parent or guardian of that child would need to be made to authenticate the wish.An appropriate adult/guardian can also wish on behalf of a child (under 18) by email to wishes@wishesandangels.com or by letter to Wish Section, Wishes and Angels, Burnett & Reid, 15 Golden Square, Aberdeen, AB10 1WF.

We cannot accept responsibility for a child who may by various methods manage to put a wish on the site against their parents/guardians wishes. Similarly if a parent's card is borrowed or stolen by the child, our usual security procedures during gifting money would not pick this up if all correct details are entered and we therefore do not take any responsibility for this situation arising either.

NUMBER OF WISHES PER HOUSEHOLD

There is no restriction on the number of wishes that may be entered from any one household. If there are five people in a house wanting to make a wish then provided they each pay the wish fee, they can do so. There are no limits on the number of Wishes that can be made as long as the wish fee of £0.50/$1.00 is made for each one.

Any amount of wishes can be made per person on the site, but, once one wish has been granted, the rule of giving back still applies, in that you must give a minimum of £1.00 to another wisher on the site before your other wishes become visible again. Please email us if this is not possible and we will override this.

PAYMENT AND SECURITY

When you give a financial gift pledge to a "wisher', you become an 'angel' and we are very grateful for all of you out there. At the point of your pledge we take your gift payment and hold this until all the pledges are made that make up the entire wish amount. At this point we procure the service or item to grant the wish. When you make your pledge you will be reminded that there is a fee of (whatever is charged by the payment processing card company) and you can choose whether to include this fee in your gift, or to let the gift minus the fee be added to the 'wishers' account. For example, if you give 10.00 to John towards a new front door, you will be told that the method you are using to pay has incurred a fee of around 4%. This is deducted from the 10.00 you wanted to give to John, so he only receives 9.60 so you may choose to add this amount and pay John 10.40.

Your money will be used for no other purpose than you have stated. The only deduction is for the bank or card processor's fee and towards the item or service you have given to, so the remaining 100% goes to the wish you have chosen.

Please note gift pledges of money are non refundable.

We shall not use your money for any other wisher unless the following happens; when any item saved for is on sale and may in the end be cheaper than expected, or the wisher's time-line has run out and they may be in a position where they have to change their wish to more or less money. At this point you will be notified that the wish has been altered and you have 2 weeks to either keep the pledge of money with this particular wisher or to distribute it elsewhere, a bit like a credit note in a shop. If we have not heard from you within the two weeks, Wishes and Angels reserve the right to distribute any spare or remaining funds to another person in the same category or to the same wishers next wish. Once again this money will not be used for any other purpose than to give to this wisher's new wish or to other wishers on the site. Where a wisher has also been saving up their own funds at home towards an item or service, the wisher should contact us when the sum of pledges of their own amount and the wish amount reaches their total. For services, we can pay direct to the service provider the Wishes and Angels part of the payment, and the 'wisher' can pay their remaining amount. For items where the 'wisher' has saved up a part of their item amount, we shall not release cash to the wisher. We ask in this circumstance that the wisher pays their amount into their own wish account and we will pay directly to the item or service provider the total amount. We have tried to include as many secure payment options as possible as accepted by PayPal who cover most credit and debit cards. All card payments using PayPal are subject to the terms and conditions and security as set out by those companies and we take no responsibility for those transactions. PayPal is a widely used and well respected payment provider within both businesses and charities.

LARGE GIFTS

Angels donating individual sums above £2,500.00 or US$5,000.00 or Euro 2,000.00 should note we will have to check the source and history of their funds so they should contact the Accounts Department on accounts@wishesandangels.com for assistance. Large Gifts will only be accepted by a bank to bank wire transfer and subject to the usual anti-money laundering procedures.

Please note: Wishes and Angels reserve the right to report any suspicious wish and gift activities to the responsible authorities.

WISH FEE

The small 'wish fee' is payable when making a wish. This is a non-returnable administration fee. We reserve the right to increase or decrease this amount when we feel it is appropriate to do so. An announcement will be made on the site if this is done. As mentioned previously, all our money is made from wish and advertising fees and a percentage of any profit from this will go back into the site. As we are not a charity, this will be after payment of UK taxes. There may be some exceptions to the paying of the wish fee and Wishes And Angels reserve the right to make a decision on this at the time of registration as a 'wisher'.

After a 'wisher' has had their wish granted, they must give a minimum £1 or $2 to another 'wisher' on the site before they make another wish. Assuming they have not already given on the site, they will now become an angel themselves. There is no limit to the amount of wishes a 'wisher' may make as long as they always pay their wish fee and contribute at least £1 or $2 to others before they make a repeat wish.Any other wishes will be faded out until this money or more has been given to another wisher.
We reserve the right to increase the wish amount when we feel appropriate. An announcement will be made on the site when and if this is done.

ANGELS

Angels will not be charged a fee for giving to 'wishers'. When an Angel gives, it is up to them as mentioned previously, whether they wish to pay the banking credit card charge.

Angels agree that should any money be surplus to requirement at the time of procurement Wishes And Angels reserve the right to distribute this money to someone else on the site. No money will be held for administrative purposes, all surplus will go back into the site wishes.

Please note Angels gifts are non-refundable once made.

COMMUNICATIONS AND BEHAVIOUR WITHIN THE SITE

Wishes and Angels provides an email system within the site whereby you may make contact with and ask questions of one another. (Please see notes to Wishers and notes to Angels regarding levels of appropriateness here).
Wishes and Angels Ltd is open to all ages including elderly people and young people under 18 (with written parental consent).
We will not tolerate any forms of abuse, swearing, unreasonable behaviour, bullying or pressurising of any kind. Wishes and Angels reserve the right to remove a 'wisher' or 'angel' at any time.
Where adequate apology and reason is given, and with the permission of the person to whom the ofence was directed, we will reinstate after a period of two weeks. Please be courteous and kind to one another bearing in mind the leap many will have taken to actually be confident enough to enter their information on this site.

Whilst we appreciate you will be looking forward to having your wish granted, we would respectfully ask you do not ask the Angels or solicit on our site to give more money to your cause. We will advertise our site on your behalf and please remember that company own Angel's will be aware if you have not had any gifts and will contribute during the time your wish is on the site. One of the things we suggest is that you inform friends and family of your wish and they can contribute to your wish and in turn tell their friends which is the whole ethos of the site. This also shows that you yourself are actively working towards helping having your wish granted.

ADDRESS AND PERSONAL DETAILS

On registration as a member on the site, you will be asked whether you would mind if information is sent to you via email, text, telephone or post.
You may decline this or you may tick only one or two boxes.
Wishes and Angels where possible will use a percentage of any extra income to benefit the site and its 'wishers'. For this reason we have decided to sell information to outside agencies who feel you may be interested in their products.
However, we will not do this without your permission and would advise you to tick or untick boxes where appropriate on registration.
The nature of the site also requires that we give your address details to the service provider or the item provider connected to your 'wish'. We would advise at all times not to give your address out to anyone on site whom you do not know and we will not be held liable for any unwanted situations should you do this.

SERVICE OR ITEM PROVIDER

Wishes and Angels will not be held liable for any issues, disputes, legal fees, claims or similar arising from problems with the item received by your supplier or services provided by your chosen provider or the provider chosen by Wishes And Angels Ltd to supply your item or service.

REGISTRATION INFORMATION

When using the site and entering personal information, you, the user, 'wisher', 'angel', agree to give accurate up-to-date information. Members are solely responsible for the security of their password and shall not abuse any other members log-in details at any point. Wishes and Angels should be notified if you feel that any unauthorized use of your account with us has taken place.

PROFILE PHOTOGRAPHS AND VIDEOS

Whilst not a requirement, it will in most cases enhance your chances of having a wish granted if a photograph or video relevant to your situation or just one of you or you and your family, is uploaded. This helps to make the 'angel' feel that they know you better and you are indeed 'real'! It is also nice once your wish is granted to maybe show a photograph of your item or that lovely new nose or front door you received!

Photos not to be permitted are ones that are of a sexual or violent nature or include inappropriate images of children, adults or animals. We are serious about what we do and we want members to feel at home and safe in our site. Wishes and Angels reserve the right to remove any photographs at any time for the above reasons without notifying the 'wisher' or 'angel' until after we have removed the photograph. The above also applies to any videos uploaded.

WE HAVE NO REASON TO AND WILL NOT KEEP COPYRIGHT OF YOUR PHOTOGRAPHS WHEN UPLOADED. WISHES AND ANGELS WILL NOT BE HELD LIABLE HOWEVER FOR ANY OTHER PERSON OR BODY COPYING AND USING YOUR PHOTOGRAPHS.

WISH INFORMATION

Members are solely responsible for the wording of and the content of their 'wish', including all photographs and videos. Wishes and Angels Ltd cannot, unless specifically stated by us on the wish, verify the authenticity of details of a wisher's need.

Wishes and Angels will allow 'angels' to ask a 'wisher' questions relating to their 'wish'. Wishers do not have to answer these questions or provide any further information but it will in many instances, enhance your chances should you choose to answer any questions or provide further information. Wishes and Angels will not be responsible for any misrepresentation, incident or legal situation occurring due to the giving of information to further the chances of a wish being granted. Angels are requested to be courteous when asking for further information from a wisher.
Any abuse of this system should be reported immediately by the wisher or angel to complaints@wishesandangels.com.

Angels should at all times be courteous in their correspondence with the wisher bearing in mind pride often takes a huge dent in times of hardship. Wishes and Angels reserve the right to permanently or temporarily suspend a 'wisher' or 'angel' where correspondence has been of a bullying nature, a threatening nature, of a fraudulent or deliberately deceptive nature.

Wishes and Angels is not here to facilitate anything of a sexual or violent nature, with reference to videos or photographs uploaded and we reserve the right to remove any such material. Similarly members may not infringe any copyright or right of publicity of any other company or individual within or outwith the site. Wishes and Angels do not authenticate the actual wish of a 'wisher' and it is the responsibility of the 'angel' to be clear in their own mind that the wish is genuine, based on information given and provided by the 'wisher'.
Wishes and Angels reserves the right to, when necessary and as we see fit, phone or write to 'wishers' regarding their wish and the authenticity thereof.
Wishes and Angels will not be liable for any offence taken at wish information or material that may be deemed offensive for not pertaining to or adhering to specific religious beliefs. Wishes and Angels will remain neutral in all political and religious queries, basing any decisions on authentication of person and wish information. Any abuse towards a 'wisher' because of race or religion will be treated in the most serious manner and will result in withdrawal of member from site either temporarily or permanently.

THOSE WITHOUT INTERNET FACILITIES AND WISHING ON BEHALF OF ANOTHER

Wishes and Angels would like to reach many people from different walks of life and in varying circumstances and all ages. It will be the case on many occasions where people will hear about us via our marketing but not have or know how to use a computer to join the site.
This is where it is permissible for you to make a second wish for someone on your own computer.
The persons details would need to be entered as if you were entering your own, with all your own details, stating that you are wishing on behalf of someone else.
The wish fee would still be applicable and you should state clearly at the beginning of the wish that you are wishing on behalf of someone else who does not have a computer.
You may then with their permission pay their fee for them using their card or your own. You may write into us with a cheque or postal order to Payments at Wishes and Angels Ltd, Burnett & Reid, 15 Golden Square, Aberdeen, AB10 1WF. We will in turn, send mail by post to these people at their home address informing them at varying stages how their wish and target is doing.

Similarly you may want to suggest to someone who is elderly or who does not have a permanent home or computer, that they write into us with their current place of abode and their circumstances and a way of communicating with them.Their wish fee would be payable at this time. We at Wishes and Angels will upload the information once we have checked their situation further. The address to write to for handwritten letters of application is Wish Dept. We will, when their target has been reached, notify them by their preferred method of communication and arrange for their item or service to be delivered to or paid direct for them. It may be difficult for some to upload photographs and if a photograph is sent, we can scan, upload and return the photograph to them. Whilst photographs are not essential, they once again help to authenticate in an 'angels' mind that the person does exist!

ADVERTISING OF OWN SERVICES OR BUSINESS

Members will in the future be given the opportunity to have advertisements within their blogs if they feel they have enough viewers of the aforementioned blog. This will give them some additional income. We shall have an announcement on the site when this service has started. Until this point it is not permitted unless under our own advertising procedure, to advertise any unauthorized sites, businesses or services by any method including junk mail, spamming or multiple letters. The site is for the sole purpose of bringing 'wishers' and 'angels' together with the aim of granting wishes.

CHARITIES AND GROUPS

Wishes and Angels is a site for individuals to list their wishes.
If you work for, or are a charity, you may list a wish alongside everyone else as a single person. The wish fee must still be paid and you must give the details of the person you are wishing for. You may for instance work for a Cancer related charity and know of someone who has, because of the area they stay in, not been able to receive a life saving drug. You could wish for the drug to be funded for them.
The other alternative is for you to alert the person needing the drug to Wishes and Angels and they themselves may place their wish. In some instances we may need some reference from the charity or their GP to validate this.
Social groups, churches, youth groups, may all list a wish. It should be from one individual in your group. This one individual however, may wish for something such as a minibus, that will benefit the whole group.

CHAT ROOMS

We provide chat rooms to discuss ways of saving money and tips for making the life of those in difficulty that bit easier. Please be courteous at all times within these rooms as many age groups are represented on this site and you do not ultimately know who you are talking to. The Chat rooms will be monitored and Wishes and Angels reserve the right to remove any member or comment from the chat room at any time.

Wishes and Angels also have pages on Facebook, Twitter, LinkedIn and YouTube. Whilst being a part of these sites gives you a wider audience for your wish request, Wishes And Angels Ltd is not responsible for any abuses of privacy or legal outcomes arising from you being registered on these sites.

THIRD PARTY SITES

Wishes and Angels will have links to other sites on the internet owned by other companies. Members of Wishes and Angels link to and use the services on third party sites at their own risk and must abide by the terms and conditions of each individual site. CHANGES TO TERMS OF USE

Wishes and Angels will honour the Terms and Conditions accepted by the member at the date at which they signed up and accepted them. Wishes and Angels reserves the right to amend or add to or change our Terms and Conditions at any time. Each member will be responsible for abiding by the regulations set out within the Terms and Conditions for which they sign.

INTELLECTUAL PROPERTY

Wishes and Angels Ltd retains all proprietary rights to the site and all associated copyright, trademarks and all proprietary rights under law. The site may only be used as laid out by us in our Terms and Conditions.
Wishes and Angels Ltd do not accept responsibility for any content uploaded by members that turn out to be the Intellectual property right of another individual, company or merchant. Members are asked to keep all content restricted to their own workings and ideas.
